Alpha Henry will argue that he was not criminally responsible due to a mental disorder for stabbing his parents to death and leaving their gasoline-soaked bodies in the bathtub of their Etobicoke apartment in 2022 — if the judge finds him guilty.

Defence lawyer Jamie Kopman raised the NCR defence for the first time in court ahead of closing submissions at the judge-alone trial on Tuesday. He told Superior Court Justice Joan Barrett he would ask for a psychiatric assessment for his client if the judge finds him guilty of second-degree murder or manslaughter, which would mean rejecting Alpha’s claim to 911 and police that it was his younger brother, Daniel, who was the real culprit.
