Conservative Leader Pierre Poilievre has hinted he’d use the notwithstanding clause to pass criminal laws if his party forms the next government. Constitutional lawyer Sujit Choudhry and former president of the Criminal Lawyers’ Association Daniel Brown both join Power & Politics to discuss the implications.

CORRECTION (May 1, 2024): A previous video title misquoted Sujit Choudhry as saying that using the notwithstanding clause would be “traumatic.” In fact, he said it would be “dramatic.” The title has been updated.
